BARS LIABLE FOR BOTH STATUTORY VIOLATIONS AND OTHER ACTS OF NEGLIGENCE FOR SERVING VISIBLY DRUNK PATRONS WHO CAUSE INJURY

A Pennsylvania Court holds in wrongful death case that a bar may be sued for both a Dram Shop Act violation and other common law negligence claims for serving a visibly intoxicated patron who then causes a car accident resulting in three fatalities. The opinion is reproduced here and does an excellent job of reviewing the relevant case law.

TEACHING MATERIALS - NEGLIGENT INFLICTION OF EMOTIONAL DISTRESS - MARCH 23, 1994

Negligent Infliction of Emotional Distress was the subject of a seminar given by Eric Purchase on March 23, 1994 to insurance defense lawyers, insurance claims adjustors, and other claims professionals. These materials were provided to attendees at the event and include the now somewhat notorious, “Negligent Infliction of Emotional Distress Flowchart.” This flowchart was reportedly kept handy by numerous insurance claims professionals for years after the seminar. I’d be interested in learning if anyone still uses it.

These materials addressed the state of the law in 1995 with regard to a personal injury victim’s obligation to reimburse public liens from the proceeds of a personal injury settlement or verdict.
